GatherClip LLC (“GatherClip,” “we” or “us”) is committed to the privacy of our customers and those who use our website www.gatherclip.com (the “Site”), and our products and services, including our cloud-based products or services (the “Services”). This Privacy Notice describes GatherClip’s policies and practices regarding our collection and use of your personal data or information and sets forth your privacy rights. We recognize that data privacy is an ongoing responsibility. We will from time to time update this Privacy Notice as we adopt new privacy practices and policies in response to updates in the law, to align with changing industry best-practices, and to reflect our product enhancements.

What types of information we collect

The following are examples of the type of information that we collect from you and how we use that information.

Cookies and Third Party Tracking We participate in behavior-based advertising, this means that a third party uses technology (e.g., a cookie) to collect information about your use of our Site so that they can provide advertising about products and services tailored to your interests on our Site, or on other websites. We have a legitimate interest in engaging in behavior-based advertising and capturing website analytics. We may advertise GatherClip products and services to you on other sites. You can choose for us not to share your information with other sites to personalize those ads as described in the “Choices you have about your information” section below.
Demographic Information We collect personal information, such as your age or location. We have a legitimate interest in understanding our users and providing tailored services.
Distance Information When you use a mobile device to access the Site we collect your location from the GPS, Wi-Fi, and/or cellular technology in your device to determine your location. We have a legitimate interest in understanding our users and providing tailored services. In some contexts our use is also based upon your consent to provide us with geo location information.
Employment If you apply for a job posting, or become an employee, we collect information necessary to process your application or to retain you as an employee. This may include, among other things, your Social Security Number. Providing this information is required for employment. We use information about current employees to perform our contract of employment, or the anticipation of a contract of employment with you. In some contexts, we are also required by law to collect information about our employees. We also have a legitimate interest in using your information to have efficient staffing and work force operations.
Feedback/Support We collect personal data from you contained in any inquiry you submit to us regarding our Site or Services, such as completing our online forms, calling, or emailing for the purposes of general inquiries, support requests, or to report an issue. We have a legitimate interest in receiving, acting upon, your feedback, issues, or inquiries and responding to your questions or comments.
Mobile Devices We collect information from your mobile device when you use the Services from your device such as including the type of device, operating system, settings, unique device identifiers and crash data. We have a legitimate interest in identifying unique visitors, and in understanding how users interact with us on their mobile devices.
Surveys When you participate in a survey we collect information that you provide through the survey. If the survey is provided by a third party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information. We have a legitimate interest in understanding your opinions, and collecting information relevant to our Services.
Website interactions We use technology to monitor how you interact with our Site. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser. We have a legitimate interest in understanding how you interact with our Site to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful. We also have a legitimate interest in detecting and preventing fraud.
Web logs When you use GatherClip, our servers record information (“log data”), including information that your browser automatically sends whenever you visit a website, or that your mobile app automatically sends when you’re using it. This log data includes your searches, browser type and settings, the date and time of your request, how you used GatherClip, cookie data and device data. We have a legitimate interest in monitoring our networks and the visitors to our Site. Among other things, it helps us understand which of our topics is the most popular. For example, we may conduct analytics and research on who is using GatherClip and what they are doing. For example, by logging how often people visit a page on GatherClip, we can understand which pages are better.


In addition to the information that we collect from you directly, we may also receive information about your activity outside of GatherClip from other sources, including third parties, business partners, our affiliates, or publicly available sources. For example, online advertisers or third parties share information with us to measure, report on or improve the performance of ads on GatherClip, or to figure out what kinds of ads to show you on or off of GatherClip. This includes information about your visits to an advertiser’s site or purchases you made from them, or information about your interests from a third-party service, which we might use to help show you ads.

What we do with the information we collect

In addition to the purposes and uses described above, we use information in the following ways:

Although the sections above describe our primary purpose in collecting your information, in many situations we have more than one purpose. When you use our Services we may collect your information to complete that transaction, but we also collect your information as we have a legitimate interest in maintaining your information after your transaction is complete so that we can quickly and easily respond to any questions about your Services. As a result, our collection and processing of your information is based in different contexts upon your consent, our need to perform a contract, our obligations under law, and/or our legitimate interest in conducting our business.

How we share your information

In addition to the specific situations discussed elsewhere in this Privacy Notice, we disclose information in the following situations:

  1. Affiliates and Acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage.

  2. Other Disclosures with Your Consent. We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Privacy Notice.

  3. Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third party intermediary.

  4. Public. Our Site may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, anyone can see the public posts you create and profile information you give us.

  5. Service Providers. We share your information with service providers. Among other things service providers help us to administer our Site, conduct surveys, provide technical support, process payments, and assist in the fulfillment of orders.

Choices you have about your information

Our goal is to give you simple and meaningful choices regarding your information. You can make the following choices regarding your personal information:

  1. Access To Your Personal Information. You may request access to your personal information by contacting us at the address described below. If required by law, upon request, we will grant you reasonable access to the personal information that we have about you. We will provide this information in a portable format, if required. Note that California residents may be entitled to ask us for a notice describing what categories of personal information (if any) we share with third parties or affiliates for direct marketing.

  2. Changes To Your Personal Information. We rely on you to update and correct your personal information. Our Site allows you to modify or delete your account profile. If our Site do not permit you to update or correct certain information, you contact us at the address described below in order to request that your information by modified. Note that we may keep historical information in our backup files as permitted by law.

  3. Deletion Of Your Personal Information. You may request information about how long we keep a specific type of information, or request that we delete your personal information by contacting us at the address described below. If required by law we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes.

  4. Objection to Certain Processing. You may object to our use or disclosure of your personal information by contacting us at the address described below.

  5. Online Tracking. We do not currently recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.

  6. Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that you receive. If you decide not to receive promotional emails, we may still send you service related communications.

  7. Revocation Of Consent. If you revoke your consent for the processing of personal information then we may no longer be able to provide you services. In some cases, we may limit or deny your request to revoke consent if the law permits or requires us to do so, or if we are unable to adequately verify your identity. You may revoke consent to processing (where such processing is based upon consent) by contacting us at the address described below.

Note that, as required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name or other account information. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our files.

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf. You must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us. If you are an authorized agent submitting a request on behalf of an individual you must attach a copy of the following information to the request:

  1. A completed written notice indicating that you have authorization to act on the consumer’s behalf signed by you and the consumer.

  2. If you are a business, proof that you are registered with the appropriate Secretary of State to conduct business in California.

If we do not receive both pieces of information, the request will be denied.

How we protect your information

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

How long we keep your information

Typically we retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Notice, unless a longer retention period is required or permitted by law. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, we’ll either remove it from our systems or depersonalize it so that we can’t identify you.

Our policy on children’s information

Children under 13 are not allowed to use GatherClip. If you are based in the EEA you may only use GatherClip if you are over the age at which you can provide consent to data processing under the laws of your country.

Transfers of Your Information

GatherClip is located in the United States. Our service providers and other third parties you may interact with in connection with our Services may be located in the United States and other countries around the world. As a result your information may be processed in a foreign country where privacy laws may be less stringent than the laws in your country. Nonetheless, where possible we take steps to treat personal information using the same privacy principles that apply pursuant to the law of the country in which we first received your information. By using our Services you agree to the transfer, storage and processing of your information in a country other than your country of residence including, but not necessarily limited to, the United States. To the extent personal information is collected and subsequently transferred out of the European Economic Area, the transfer will take place consistent with the Standard Contractual Clauses. If you think that we haven’t complied with data protection laws, you have a right to lodge a complaint with the Data Protection Commission in Ireland or with your local supervisory authority.

Because GatherClip is a worldwide service, we may transfer the personal data of EEA residents to a country outside the EEA. Where we transfer information from the EEA to a country that doesn’t provide an adequate level of protection, we’ll only do so under appropriate safeguards to protect your information, like standard contractual clauses.

California residents

California Civil Code Sections 1798.115(c), 1798.130(a)(5)(c), 1798.130(c), and 1798.140 indicate that organizations should disclose whether the following categories of personal information are collected, transferred for “valuable consideration,” or transferred for an organization’s “business purpose” (as those terms are defined under California law).

We do not “sell” your personal information. The table below indicates the categories of personal information we collect and transfer in a variety of contexts including to Service Providers ” (as defined under California law). Please note that because this list is comprehensive, it may refer to types of information that we collect and share about people other than yourself. We are also required to communicate information about rights California residents have under California law.
